06.1 General
The Master is responsible for his ship and is to conduct his command according to Flag state legislation, International Conventions and regulations and the Company’s specific instructions.
The Master has the overriding authority and the responsibility to take whatever action he considers, in his professional judgement, to be in the best interests of the safety of the crew, passengers, ship, cargo and the marine environment irrespective of economic or commercial considerations.
06.2 Responsibilities
The Master is responsible for:
• Such matters, responsibilities and duties as laid out in this safety management system,
• Implementing the Safety and Environmental Protection Policy on their ship,
• Implementing this safety management system onboard,
• Motivating the crew in the observation of the Safety and Environmental Protection Policy and this safety management system,
• Verifying that the requirements of this safety management system are being observed,
• Periodically reviewing this safety management system in accordance with the relevant section,
• Ensuring that the ship is at all times operated in a safe and effective manner, having regard to all relevant international and national legislation, rules, regulations, directive or other requirements,
• Communicating effectively with all onboard and with the ship management team and fleet office, reporting issues or requirements in good time and in sufficient detail,
• Requesting assistance from the ship management team or fleet office as required, ensuring the continued safe, effective and compliant operation of the vessel,
• Ensuring that all surveys and inspections that are required are carried out in good time to ensure the continued compliance of the vessel with all operating and legal requirements,
• Monitoring the validity of all required certificates and taking action in good time to ensure that they do not expire,
• Making such reports as are required by this safety management system to the company in good time
• Making such reports as are required by this safety management system and by international or national legislation, rules, regulations, directives or other requirements in the event of an incident occurring.
06.3 Commercial Pressure
The Master must not take any action that puts the ship, her crew, cargo or the marine environment in undue danger, and must not be persuaded to do so as a result of commercial pressure from any company, individual or other interested party. The Master must not accept for himself, or on behalf of any crew member, “bonuses” or any other payments intended to induce him, or them, to carry out, or neglect to carry out, any act the result of which would be the putting of the ship in this situation.
